Terms of sale

The owner of the web store nimeline.ee (hereinafter Web Store) is Nimeline OÜ (registry code 12031477) located at Mustamäe tee 165-46, 12913 Tallinn.

Sales contract validity, product and price information

The terms of sale are valid if  ordering products from the Web Store. The prices of the products sold in the Web Store are in euros and include VAT valid in the Republic of Estonia. The delivery fee is added to the price of the products. The delivery fee depends on the location and the method of delivery. The delivery service fee is shown to the buyer when orderig.

Information about the products is provided in the Web Store directly next to the product.

Nimeline OÜ reserves the right to make changes in the sale conditions and prices by publishing the new conditions on the website nimeline.ee.

Placing orders

To order a product, you must add the desired product to the shopping cart and check the crrectness of the order. To place an order, fill in the required fields and select the appropriate delivery method from the predefined options (Itella SmartPOST parcel machine, Omniva standard letter, Omniva registered letter). Then the amount of the order fee in euros is displayed on the screen, which can be paid securely via Montonio Finance OÜ, which offers a payment solution. The sales contract between the Web Store and the buyer enters into force upon receipt of the amount payable to the current account of the Web Store.

In case of immediate non-payment for the order, the term for payment of the prepayment invoice is 3 working days. If the invoice is not paid within this time, the order will be canceled automatically .

To activate the discount with the coupon, enter the coupon code in the appropriate box and confirm the wish to use the coupon with the “Apply coupon” button.

When making an order, the buyer’s details must be entered.

If the data of the buyer and the recipient of the order are different, the option “Send to another address?” must be selected and the data of the recipient must be entered in addition to the data of the buyer.

Delivery

Orders are sent to the following countries: Estonia, Finland and Sweden. The delivery service fee is paid by the buyer and the service fee information is displayed next to the delivery method.

The order will be posted within 10 working days at the latest, if the order has been paid for.

Right of withdrawal

Due to the order fulfillment process, the buyer has the right to withdraw from the contract within 24 hours from the conclusion of the sales contract by notifying the Web Store in writing by e-mail (info@nimeline.ee). When canceling an order, be sure to indicate the order number you wish to cancel. Upon withdrawal from the contract at the request of the buyer, the Web Store will return the amount paid for the products to the same current account from which the buyer paid for the order. The refundable amount will be refunded by the Web Store immediately, but not later than within 14 calendar days from the receipt of the written withdrawal application.

Products ordered from web store of Nimeline OÜ, which are made taking into account the customer’s personal needs and/or the conditions provided by the buyer (eg name printed on the name label, telephone number, other personal data) are not subject to a 14-day right of return.

The Web Store has the right to withdraw from the contract if the ordered products cannot be delivered due to the end of the products or for any other reason. The buyer will be notified as soon as possible by telephone or e-mail and the amount paid for the order will be refunded immediately, but not later than within 14 calendar days of the notification of withdrawal.

Return and replacement of non-compliance products

The Web Store is responsible for non-compliance or defect of the products sold to the buyer, which already existed at the time of delivery of the products and which becomes apparent within two years from the delivery of the products to the buyer. During the first six months from the delivery of the products to the buyer, it is presumed that the defect already existed at the time of delivery. It is the responsibility of the Web Store to rebut the respective presumption.

The buyer has the right to submit the claim to the Web Store no later than within two months of the occurrence of the defect by sending an e-mail to info@nimeline.ee. The application must contain the order number, the date of submission of the claim, the description of the defect and the requirement for the Web Store. The Web Store will respond to the submitted claim in writing or in a form that can be reproduced in writing within 14 days.

The Web Store is not responsible for:

  • for a defect that has occurred as a result of improper use of the product;
  • the natural physical wear and tear of the product during use;
  • installation that does not comply with the instructions;
  • damage to the product when washing the product, as it is not possible to give a guarantee for the product against all different chemical substances (eg washing powders, bleaches, stain removers, etc.);
  • the delay in delivery, if it is due to circumstances beyond the control of the Web Store and / or force majeure beyond its control.

The Web Store does not compensate:

  • for damages caused by improper use of the product;
  • moral damage that may occur to the buyer or recipient by changing the delivery times, prices and other conditions in these terms of sale;
  • the costs arising from the fact that the buyer has assumed obligations to third parties (ie not dependent on the Web Store) on terms that are in conflict with these terms of sale;
  • the damage caused by installation that does not comply with the instructions.

If the product ordered from the Web Store has defects for which the Web Store is responsible, the Web Store will replace the defective product. If the product cannot be replaced, the Web Store will return  all fees associated with the sales contract to the buyer.

Processing of personal data

The Web Store uses the personal data entered by the buyer (incl. name, telephone number, address, e-mail address) only to complete the order and send the products. The Web Store transmits personal data to the company providing the transport service in order to deliver the order. The Web Store forwards the personal data necessary for making payments to the authorized processor Montonio Finance OÜ.

The customer is responsible for ensuring that the customer’s registration data (e-mail address, username and password) do not fall into the hands of third parties. The Web Store is not responsible for the consequences that  have arisen due to the customer’s fault when  the customer’s login data falls into the hands of third parties.

Dispute settlement

If the buyer has any complaints regarding the Web Store, they must be sent to the e-mail address info@nimeline.ee. If the buyer and the Web Store are unable to resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Web Store.

In case of disputes, the terms of sales in Estonian shall prevail.
